Analisis Teori Keadilan Mengenai Pencabutan Presidential Threshold di Indonesia Bagus

Abstract

Presidential threshold is a minimum vote limit that must be achieved by a presidential candidate to be elected as president. This study aims to analyze the fairness influenced by the revocation of the presidential threshold in Indonesia. Through an in-depth study of election regulations and post-revocation political dynamics, this research finds that the abolition of the party threshold in nominating presidential candidates has opened up space for more inclusive political participation. The research method used is a qualitative  method  with data  collection techniques  through  analysis of  legal  norms,  legal  theory, legislation, and documents. The results of the study indicate that the revocation of the Presidential. Threshold has an influence on the fairness of executive elections in Indonesia.

Presidential threshold adalah batasan minimal suara yang harus diraih oleh calon presiden untuk dapat dipilih sebagai presiden. Penelitian ini bertujuan untuk menganalisis keadilan yang dipengaruhi oleh pencabutan presidential threshold di Indonesia. Melalui kajian mendalam terhadap regulasi pemilu dan dinamika politik pasca pencabutan, penelitian ini menemukan bahwa  pencabutan  ambang  batas  partai  politik  dalam  mengajukan  calon  presiden  telah membuka ruang bagi partisipasi politik yang lebih inklusif. Metode penelitian yang digunakan adalah metode kualitatif dengan teknik pengumpulan data melalui analisis norma hukum,teori hukum, peraturan perundang-undangan dan dokumen. Hasil penelitian menunjukkan bahwa pencabutan Presidential Threshold berpengaruh pada keadilan pemilihan umum eksekutif di Indonesia.
